Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services (collectively, the "Services") provided by Moxie Labs Inc. ("Moxie", "we", "us"). By using the Services, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum age required in your country) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. License to Use the Services

Subject to your compliance with these Terms, Moxie grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business use.

3. Subscriptions, Billing & Payments

  • Paid plans are billed in advance on a recurring basis (monthly or annually) unless otherwise stated at checkout.
  • Payments are processed by our payment provider, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the applicable fees and any taxes.
  • Subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
  • Prices may change with at least 30 days' notice before your next renewal.

4. Refunds

Our refund policy is described on our Refunds & Cancellations page and forms part of these Terms.

5. Acceptable Use

You agree not to:

  • Use the Services to violate any law or the rights of others;
  • Attempt to reverse engineer, decompile, or circumvent any security mechanism of the Services;
  • Upload malware or use the Services to send spam or unsolicited communications;
  • Resell, sublicense, or commercially exploit the Services without our written consent.

6. Intellectual Property

The Services, including all software, designs, and content provided by Moxie, are owned by Moxie or its licensors and are protected by intellectual property laws. You retain ownership of content you submit through the Services and grant Moxie a worldwide license to host and process it solely to operate the Services.

7. Termination

We may suspend or terminate your access to the Services at any time for breach of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Moxie's total liability arising out of or relating to the Services shall not exceed the amounts you paid to Moxie in the twelve (12) months preceding the claim. Moxie shall not be liable for indirect, incidental, special, or consequential damages.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Disputes shall be resolved in the state or federal courts located in Delaware.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced on this page and, where appropriate, by email. Continued use of the Services after changes take effect constitutes acceptance.
